How Much Compensation for Whiplash in 2026? The Tariff Explained
If your whiplash came from a car accident in England or Wales, the amount you receive is almost certainly fixed by law — not negotiated. The statutory tariff currently runs from £275 to £4,830 for whiplash alone, or £300 to £4,975 where minor psychological injury accompanies it.

Accidents before 31 May 2025 use the original 2021 table, roughly 15% lower. The next statutory review is due in 2027.
Why Whiplash Payouts Fell So Sharply
Before the Civil Liability Act 2018 reforms took effect in May 2021, a 12-month whiplash injury was typically worth £3,000–£4,500 under the Judicial College Guidelines. The same injury today attracts a tariff award of £1,510 — a cut of roughly two-thirds, introduced to reduce claim volumes and insurance premiums. Whether premiums actually fell is a matter of ongoing debate; claim volumes certainly did.
Four Routes to More Than the Tariff
- Symptoms beyond 24 months. You leave the tariff entirely — the claim is valued under JCG neck injury brackets, which start around £5,750 for injuries in this range and climb steeply where symptoms persist.
- Not a road traffic accident. Whiplash from a workplace incident or fall was never covered by the tariff. Full JCG valuation applies.
- Additional injuries. Only the whiplash element is tariff-fixed. A wrist fracture, concussion or diagnosed psychiatric injury from the same crash is valued separately under the Guidelines and added on top. These mixed claims are routinely worth several times the tariff element.
- Exceptional circumstances. Courts can uplift the tariff by up to 20% where the injury or its effect on you was exceptionally severe for the band.
The Medical Report Is Everything
Your tariff band is set by the prognosis in a MedCo-accredited medical report — insurers cannot lawfully settle without one. If the expert writes “symptoms expected to resolve within 10 months from the accident”, you are in the 9–12 month band: £1,510. Describe your symptoms fully and honestly at the examination; understating them costs you a band.
Claiming Without a Solicitor
Tariff-level claims go through the free Official Injury Claim portal — a solicitor’s no-win-no-fee deduction makes little sense against a fixed £1,510 award. The exception: any of the four escape routes above, where the amounts justify professional handling.
